H1B (Cap Exempt) Visa
H-1B Visa (Exempt Balloting) for Teachers and Nurses – Your Gateway to the USA
Are you a qualified teacher or nurse looking for an opportunity to work in the United States? The H-1B visa (Cap-Exempt) pathway provides an excellent opportunity for educators and healthcare professionals to secure employment in the U.S. without being subject to the annual H-1B lottery. Superior Consulting Global is here to guide you through the process with expert assistance, ensuring a smooth and successful application.
What is the H-1B Visa (Cap-Exempt)?
The H-1B visa is a non-immigrant work visa that allows U.S. employers to hire foreign professionals in specialty occupations. While the standard H-1B visa is subject to an annual cap of 85,000 visas (including 20,000 reserved for advanced degree holders), some institutions and organizations are exempt from this lottery system.
Who Qualifies for an H-1B Cap-Exempt Visa?
Certain nonprofit organizations, research institutions, government research organizations, and educational institutions are exempt from the H-1B lottery. This means teachers and nurses working for these organizations can apply at any time of the year without waiting for the cap season.
Why Choose the H-1B Cap-Exempt Visa?
-
No Lottery Requirement – Direct processing without waiting for annual H-1B quotas.
-
Year-Round Availability – Apply at any time without restrictions.
-
Faster Processing – Get your visa processed more quickly than the standard H-1B.
-
Long-Term Career Growth – Pathway to permanent residency (Green Card).
Eligibility Criteria for Teachers and Nurses
Teachers
Qualified K-12 teachers, college instructors, and university professors are eligible if they have:
-
A bachelor’s degree or higher in education or a related field.
-
A valid teaching certification (if required by the U.S. state they wish to work in).
-
A job offer from a cap-exempt institution, such as a public school, university, or nonprofit educational institution.
Nurses
Registered nurses (RNs) qualify if they meet the following:
-
Hold a Bachelor of Science in Nursing (BSN) (or equivalent foreign degree).
-
Have a valid U.S. state nursing license or NCLEX-RN exam clearance.
-
Have a job offer from a cap-exempt employer, such as a teaching hospital, nonprofit healthcare institution, or research facility.
Steps to Apply for the H-1B Cap-Exempt Visa
The process involves five key steps:
Step 1: Employer Sponsorship
A U.S. employer (school, university, or hospital) must sponsor your visa. Superior Consulting Global will assist you in:
-
Finding a cap-exempt employer willing to sponsor your H-1B.
-
Ensuring you meet all eligibility and licensing requirements.
Step 2: Labor Condition Application (LCA)
Your employer must file an LCA with the U.S. Department of Labor (DOL), ensuring:
-
You will be paid a prevailing wage.
-
Your working conditions comply with U.S. labor laws.
Step 3: Filing the H-1B Petition (Form I-129)
Once the LCA is approved, your employer will file Form I-129, Petition for a Nonimmigrant Worker, with U.S. Citizenship and Immigration Services (USCIS).
Step 4: USCIS Processing & Approval
-
USCIS will review your application and may request additional evidence.
-
If approved, you will receive Form I-797, Notice of Action.
Step 5: Visa Stamping & Travel to the USA
-
If you are outside the U.S., you must apply for H-1B visa stamping at a U.S. embassy or consulate.
-
Once stamped, you can enter the U.S. and begin working with your employer.
